U.S. District Judge Jamel Samper has denied a motion by New Jersey State Representative (D) LaMonica McIver to not face trial over charges related to her assault of a federal official. She was caught on video assaulting an ICE officer at an ICE detention facility in Newark, NJ.

A federal judge on Tuesday denied Milwaukee County Judge Hannah Dugan’s motion to dismiss charges against her for helping an illegal immigrant evade ICE agents.

Last month, a federal magistrate judge ruled that Hannah Dugan is not entitled to dismiss her federal case based on judicial immunity.

A Democrat congresswoman is scheduled to appear in court Wednesday to face federal charges after allegedly obstructing Homeland Security agents during a chaotic scene at an immigration facility last month.

Rep. LaMonica McIver (D-NJ) has been indicted on three counts, including forcibly impeding federal officers during the attempted arrest of Newark Mayor Ras Baraka at the Delaney Hall immigration facility on May 9.

McIver has stated through her legal team that she intends to plead not guilty.

According to the Department of Justice (DOJ), the incident unfolded when McIver and two other members of Congress claimed they were conducting a “congressional oversight visit” that coincided with an organized immigration protest.

Federal agents said Mayor Baraka was initially granted access to a restricted area but refused to leave when ordered.

When officers attempted to arrest him for trespassing, McIver allegedly intervened physically, placing herself between the mayor and the officers, slamming her forearm into one agent and grabbing another by the arms, using force to block the arrest.

The DOJ notes that the first two charges against McIver each carry up to eight years in prison, while the third charge carries a maximum one-year sentence.

The case is being prosecuted by Acting U.S. Attorney Alina Habba, a former legal representative for President Donald Trump.

Aftyn Behn, a Democratic Tennessee State Representative, posted a video bragging about how she followed ICE troopers in her car to harass them. It’s unclear if she thought the video made her appear morally superior, but I would never recommend interfering with federal enforcement to get clicks.

Last week, a federal grand jury indicted Milwaukee County Circuit Judge Hannah Dugan on two counts stemming from an April incident where witnesses said she helped 30-year-old Mexico native Eduardo Flores-Ruiz, an illegal immigrant, evade an arrest from ICE that would have taken place outside of her courtroom.

As we’ve reported, Dugan allegedly steered Flores-Ruiz and his attorney out of her courtroom, where Flores-Ruiz had been for a pre-trial hearing on three misdemeanor counts of battery, and through the jury doorway instead of the main courtroom door, where members of ICE were waiting outside for his hearing to conclude.

Per the FBI charging document, Dugan stands accused of two U.S. Code violations: “Obstructing or impeding a proceeding before a department or agency of the United States” and “Concealing an individual to prevent his discovery and arrest.”

Dugan has pleaded not guilty. After her indictment, her attorneys filed a motion to dismiss on the grounds that “she is entitled to judicial immunity for her official acts.”
