The Supreme Court will hear TikTok’s challenge to its looming ban if its parent company, China-based ByteDance, does not sell the popular video app.
The case will be argued on Jan. 10, 2025, just nine days before the ban is set to take effect. If the ban does go through, TikTok will be banned from all U.S. app stores. TikTok is arguing the ban is unconstitutional and violates the First Amendment.
Earlier this year, both chambers of Congress, with bipartisan support, voted to ban the app after years of questioning its possible connections to the Chinese Communist Party, leading to concerns about national security. In April, President Joe Biden signed the law, which requires ByteDance to sell the app or be banned.
As the case now sits before the Supreme Court, TikTok has lost all its previous court battles to reverse the law. The U.S. Court of Appeals for the District of Columbia Circuit refused TikTok’s request to delay the implementation of the law last week, which prompted the company to turn to the high court.
