In the latest object lesson in why we need voter ID laws and why motor-voter initiatives are a terrible idea, the Oregon Department of Motor Vehicles quietly announced late last week that over 300 non-citizens had been accidentally registered to vote.

Furthermore, The Oregonian’s report on the matter seemed to indicate a number of these 306 people illegally registered to vote were also here illegally, as well.

“The mistake occurred in part because Oregon has allowed undocumented residents to obtain driver’s licenses since 2019 and the DMV automatically registers most individuals to vote when they obtain a license or ID, according to Kevin Glenn, spokesperson for the Oregon Department of Transportation, which oversees the DMV,” the report said.

“Glenn said an initial analysis by the state transportation agency revealed 306 non-citizens were allowed to become registered voters. Of those, only two have cast a vote in any election since 2021, Glenn said.

AB 2655, also known as the Defending Democracy from Deepfake Deception Act of 2024, requires online platforms “to block the posting of materially deceptive content related to elections in California” and “to label certain additional content inauthentic, fake, or false” during designated periods before and after an election.

AB 2355 expands upon existing law and requires a committee that creates, publishes, and/or distributes some political advertising to add a “disclosure” noting when an ad has been “generated or substantially altered” using AI. The bill addresses “any image, audio, or video that is generated or substantially altered using artificial intelligence” that would give a reasonable person “a fundamentally different understanding of the altered media when comparing it to an unaltered version.”

AB 2839 also builds upon existing law that already prohibits people from knowingly distributing, with malice, election material containing “certain materially deceptive content.” Previous law required this statute to be enforced 60 days before an election. It will now be enforced 120 days before an election and, in certain cases, up to 60 days afterward.

In a statement, Newsom insisted these speech restrictions were necessary for the sake of democracy.

“Safeguarding the integrity of elections is essential to democracy, and it’s critical that we ensure AI is not deployed to undermine the public’s trust through disinformation – especially in today’s fraught political climate,” Newsom said. “These measures will help to combat the harmful use of deepfakes in political ads and other content, one of several areas in which the state is being proactive to foster transparent and trustworthy AI.”

Gov. Chris Sununu, R-N.H., signed a no-excuse voter identification and proof-of-citizenship bill into law last week, but it will not go into effect until six days after this year’s election.

The law, which passed the state’s Republican-majority House and Senate earlier this year, will require New Hampshire voters to provide proof of citizenship to apply for registration, as well as a photo ID when casting a ballot. In the event a person can’t show a valid ID, the supervisor may “review the voter’s qualifications and determine if the voter’s identity can be verified.”

“If the supervisor of the checklist determines that the voter’s qualifications and identity have not been established, the voter shall not be allowed to vote,” the law clarifies.

What does the law say?

A 1996 U.S. law makes it illegal for noncitizens to vote in elections for president or members of Congress. Violators can be fined and imprisoned for up to a year. They can also be deported.

When people register to vote, they confirm under penalty of perjury that they are U.S. citizens. Federal law requires states to regularly maintain their voter rolls and remove anyone who is ineligible, a process that could identify immigrants living in the country illegally.

No state constitutions explicitly allow noncitizens to vote, and many states have laws that prohibit noncitizens from voting for state offices such as governor or attorney general. But some municipalities in California, Maryland and Vermont, as well as the District of Columbia, do allow voting by noncitizens in some local elections such as for school board and city council.

Republicans are once again raising the issue of voter fraud, despite not a single vote having been cast in the 2024 presidential election yet. More specifically they have been pointing to immigrants coming into the US from the southern border, suggesting they might be illegally voting this fall. Veuer’s Tony Spitz has the details.

 

 

What is Congress doing?

Congress needs to approve a stopgap spending bill before the Sept. 30 end of the budget year to avoid a government shutdown. At the urging of some Republicans, Johnson is seeking to combine a six-month extension of government spending with a measure requiring proof of citizenship, such as a birth certificate or passport, to register to vote.

Johnson, who said Congress has a responsibility to “ensure that only American citizens can decide American elections,” has put off a vote on the measure for now because it doesn’t have enough support to pass. But Johnson is signaling he’s not backing off linking the two main pillars of the bill.

 

 

 

The plan is similar to a bill Republicans pushed earlier this year known as the Safeguard American Voter Eligibility Act. That legislation passed the Republican-led House in July largely along partisan lines but has not come to a vote in the Democratic-led Senate.

House Democratic Leader Hakeem Jeffries said that he opposes the latest Republican attempt to require proof of citizenship for voter registration. He said the stopgap spending bill should be free of “partisan policy changes.”

The Biden administration also has opposed the Republican efforts while asserting that existing laws against noncitizen voting are working.

What does the data say?

Data from states indicates that voting by noncitizens is rare.  But Republican officials have highlighted voter registration reviews that turned up potential noncitizens.

Texas Gov. Greg Abbott, a Republican, said last month that more than 6,500 potential noncitizens have been removed from Texas voter rolls since 2021, including 1,930 with “a voter history” who have been referred for investigation by the attorney general’s office. Texas has almost 18 million registered voters.

Ohio Secretary of State Frank LaRose, a Republican, said in August that he referred for potential prosecution 138 apparent noncitizens found to have voted in a recent election and 459 more who registered but did not vote. Those figures were higher than reviews from previous years but a small fraction of the more than 8 million registered voters in Ohio.

 

 

 

Alabama Secretary of State Wes Allen, a Republican, recently announced that 3,251 people previously identified as noncitizens by the federal government are being switched to inactive status on the state’s voter registration rolls. They will be required to provide proof of citizenship and fill out a form to vote this fall. Alabama has more than 3 million registered voters.

In Georgia, Republican Secretary of State Brad Raffensperger found that 1,634 potential noncitizens tried to register to vote between 1997 and 2022, though election officials flagged them and none was registered. Georgia registered millions of other voters during that time.

Some election administration experts have said the voter roll reviews show that current tools to flag noncitizen voters are working.

What do the courts say?

Arizona provides a case study for the long-running attempts by Republicans to prohibit noncitizen voting.

Under a 2004 voter-approved initiative, Arizona required a driver’s license, birth certificate, passport or other similar document to approve a federal voter registration application. But the U.S. Supreme Court ruled in 2013 that Arizona cannot require documentary proof of citizenship for people to vote in federal elections.

The state responded by creating two classes of voters. For state and local elections, voters must provide proof of citizenship when they register or have it on file with the state. But because that cannot be required in presidential and congressional elections, tens of thousands of voters who have not provided proof of citizenship are registered only for federal elections.

An August order by a divided U.S. Supreme Court will allow voter registration forms submitted without “documentary proof of citizenship” to be rejected by Arizona counties while litigation over the law continues. People will be able to register to vote in presidential and congressional elections using a different federal form that requires people to swear they are citizens under penalty of perjury, without requiring proof.

 

 

 

What’s on the ballot?

Republican-led legislatures in eight states have proposed constitutional amendments on their November ballots declaring that only citizens can vote.

Proposals in Iowa, Missouri, North Carolina, Oklahoma, South Carolina and Wisconsin would replace existing constitutional provisions stating that “every” citizen or “all” citizens can vote with new wording saying “only” citizens can vote. Supporters contend the current wording does not necessarily bar noncitizens from voting.

In Idaho and Kentucky, the proposed amendments would explicitly state: “No person who is not a citizen of the United States” can vote. Similar wording won approval from Louisiana voters two years ago.

Voters in North Dakota, Colorado, Alabama, Florida and Ohio passed amendments between 2018 and 2022 restricting voting to “only” citizens.

What else are states doing?

Although noncitizen voting already is prohibited in the state constitution, Republican Gov. Jeff Landry of Louisiana is continuing to draw attention to the issue. He recently signed an executive order requiring state agencies that provide voter registration forms to include a written disclaimer that noncitizens are prohibited from voting.

In Georgia, Raffensperger is requiring every polling place to post a sign in English and Spanish warning noncitizens that it is illegal to vote.

Republican Attorney General Ken Paxton of Texas, citing “significant growth of the noncitizen population” in the state, set up a special email account to report suspected violations of election laws.

In Wisconsin, Republicans have filed a pair of similar lawsuits in recent weeks that challenge the state’s process for verifying whether a registered voter is a citizen. The lawsuits seek court orders requiring the elections commission to perform checks to ensure there are no registered voters who are noncitizens.

North Carolina Republicans have sued the state election board, alleging it is not enforcing a new law aimed at removing people from voter rolls who seek jury duty exclusions because they are not citizens.

Tennessee’s top election office sent letters in June asking for proof of citizenship from more than 14,000 registered voters, though those who failed to respond won’t be barred from voting. The list was based on data from the state Department of Safety and Homeland Security, which has information about whether residents were U.S. citizens when they first interacted with that department.

Pennsylvania Auditor General Timothy DeFoor, a Republican, sent a letter Monday to PennDOT Secretary Michael Carroll and Neil Weaver, secretary of the Governor’s Office of Administration, informing them that the auditor’s office will be conducting a performance audit of the motor voter registration process.

The audit will look at the automatic voter registration system covering the period between Jan. 1 and June 30.

Specifically, it will look at the implementation of the program, its compliance with the National Voter Registration Act of 1993, and how it relates to the state election code. The audit will also “determine whether PennDOT’s Motor Voter interface files sent to the Pennsylvania Department of State properly excluded non-citizens.”

It is unlikely the audit’s results will influence the 2024 election. DeFoor set a deadline of Oct. 4 for a meeting to be held between PennDOT and the auditor. Draft notes and audit information are not made public. PennDOT will have 120 business days to submit a response to the audit. The election is less than 50 days away.

Pennsylvania’s Democrat-controlled supreme court shot down left-wing presidential candidate Cornel West’s bid to appear on the state’s 2024 ballot.

In a reportedly unsigned order, the Keystone State’s highest court affirmed a lower court ruling denying West’s bid for ballot access. In that ruling, Commonwealth Court Judge Renee Cohn Jubelirer sided with the office of Secretary of State Al Schmidt “in rejecting West’s candidacy paperwork,” according to the Washington Examiner.

Schmidt’s office had argued that “the paperwork lacked the affidavits for 14 of the 19 presidential electors required by the Aug. 1 filing deadline,” according to the outlet.

Schmidt indicated prior to Monday’s decision that a final ruling on West’s case by the Pennsylvania Supreme Court would allow counties to begin printing ballots for the November contest. Schmidt is a self-professed “Republican” and was appointed by Democrat Gov. Josh Shapiro.

“As soon as the court rules on that, we’ll certify the official list and then counties can complete their preparations to mail out ballots and to have voters, if they choose, go to a county election office to apply in person,” he reportedly said.

The rate of mail-in voting rose to above 50 percent in Michigan and Wisconsin, and almost 40 percent in Pennsylvania.

The old “Blue Wall” was an impregnable fortress of safely Democrat states because of large blocs of blue-collar voters — mainly in the Rust Belt of the upper Midwest — that could be relied upon to get Democrats an electoral college victory in a close election. The old “Blue Wall,” however, dramatically failed to protect Hillary Clinton’s candidacy, as an unexpectedly large number of formerly Democrat, working-class voters in Rust Belt states became Donald Trump voters.

DeSantis told “Sunday Morning Futures” host Maria Bartiromo on Fox News that the state has banned ballot harvesting and imposed serious penalties for offenders.

“We require photo ID in order to vote,” he said. “We’ve banned the use of Zuckerbucks, and we’ve been aggressive at policing the voter rolls so that we have accurate voter rolls, and when people have run afoul of our election laws, this election crimes unit we’ve created has been able to investigate, refer these people to prosecution, and you’ve had over 50 people just in the last couple years that have been convicted of various types of voter fraud.”

“In the state of Florida, we require voter ID,” he continued. “We also prohibit issuing any type of photo ID to illegal aliens, no driver’s license, no local government IDs, no private organizations are allowed to issue illegals photo ID, and we don’t recognize out of state licenses or any type of ID for illegals. What that means is it’s almost impossible for an illegal to register to vote. In some of these states where they do issue those ID cards, they can go in, and there’s really no check of the citizenship that has been done. So we’ve been very aggressive in ensuring that only US citizens are on the voter rolls. When we’ve identified people that have voted illegally who are not US citizens, we have brought prosecutions against them.”

This week, a federal court will take up a case challenging a 2023 Minnesota law that prohibits employers from discussing religious or political matters at required meetings, including meetings on elections, regulations, and whether employees should join a union.

According to a recent Wall Street Journal editorial, Gov. Tim Walz, D-Minn., bragged about the impact of the new law, saying that employers will either have to toe the line or be sent to jail.

Making matters worse, Walz also personally appointed all the members of Minnesota’s teacher licensing board, which recently instituted new rules restricting and coercing teachers’ speech. These new regulations “require educators to ‘affirm’ their students’ gender identities, have ‘racial consciousness,’ and learn to ‘disrupt oppressive systems,’” according to Fox News. Count me in as one of those who are shocked yet perhaps not terribly surprised that Walz believes that there should be no guarantees to free speech in America.

Couple Walz’s attacks on free speech with attempts from the political left (and Walz’s attorney general in particular) to put public pressure on social media platforms, such as Elon Musk’s X, and the message is clear. Our First Amendment is under attack.

Nearly two dozen Democratic seats are up for reelection in 2024, with five incumbents seen as vulnerable, while only 10 Republicans face reelection. However, Republicans in six critical races are trailing Trump and their Democratic opponents.

The only Senate GOP candidate who is consistently leading is Montana Republican Tim Sheehy. In an average of polling, Sheehy is ahead of incumbent Sen. Jon Tester (D-MT) by 5.2 percentage points. However, Sheehy’s lead is not as strong as Trump’s in Big Sky Country, in which he leads by an average of 17.6 percentage points.

Senate Majority Leader Chuck Schumer (D-NY) has a 51-seat advantage and the ability to tap Vice President Kamala Harris for any tiebreaking votes. He is already expected to lose one seat in West Virginia with the retirement of Sen. Joe Manchin (I-WV). If Republicans win in Montana, they’ll be able to capture the majority, but the race for control of the upper chamber is still up in the air in a cycle that favors Republicans.
