A split federal appeals court panel on Tuesday upheld a trespassing charge against a January 6 rioter, Couy Griffin — a charge that has also been applied to hundreds of others — affirming that rioters “knowingly” breached restricted areas that day even if they didn’t know the basis of that restriction — that the Secret Service was protecting then-Vice President Pence, who was inside.

At issue in the case before the D.C. Circuit Court of Appeals was a federal law that prohibits “knowingly” entering “restricted building or grounds,” defined as any “posted, cordoned off, or otherwise restricted area,” including restricted areas where the “president or other person protected by the Secret Service” is visiting.

Mr. Griffin, a founder of Cowboys for Trump and a former New Mexico county commissioner who was ousted from his position under the 14th Amendment’s insurrection clause, had argued that the government must prove that he knew the reason why the area was restricted for him to have “knowingly entered.” He also argued that because so many rioters before him had trampled the signage along the area, the restricted grounds were no longer clearly “posted, cordoned off, or otherwise restricted.”

More than 1,400 January 6 defendants have been charged with “entering or remaining” on restricted federal grounds, the Justice Department has said, meaning that hundreds of charges could have been undermined if the court had ruled in Mr. Griffin’s favor.

A former high-ranking cabinet official in the Obama Administration is providing legal services to a Chinese military company as it files a lawsuit against the Department of Defense (DOD).

As the Daily Caller reports, former Attorney General Loretta Lynch, who served as the final Attorney General in Barack Obama’s Cabinet from 2015 to 2017, is one of the five attorneys representing Chinese drone manufacturer DJI. Her services, along with the other four lawyers, are being provided by the firm Paul, Weiss, Rifkind, Wharton, & Garrison.

DJI filed its lawsuit on October 18th, challenging the Pentagon’s decision to designate the company as a “Chinese military company.” DJI was added to the Pentagon’s list of Section 1260H entities, determining that the company is “directly or indirectly owned, controlled or beneficially owned by” the Chinese military, and provides direct support to Chinese weapons manufacturing.

Lynch’s lawsuit claims that DJI “is neither owned nor controlled by the Chinese military and … sells only ‘consumer and commercial’ — not military — drones.” The company also insists that, as a result of the designation by the DOD, the company has suffered “ongoing financial and reputational harm.”

In a blistering statement on Monday, Congresswoman Elise Stefanik (R-N.Y.), declared that “Barack Obama’s former Attorney General Loretta Lynch has turned her back on her nation, selling out to our greatest adversary Communist China and suing the United States on behalf of CCP-owned drone company DJI.”

In the spring of 2022, Team Red was eagerly rubbing its hands together in anticipation of walloping the Democrats in the upcoming midterm elections. Then SCOTUS handed down its Dobbs v. Jackson decision, and we became the proverbial dog that caught the car.

Democrats seized their opportunity. I wrote at the time that “Democrats are going all-in on a massive abortion pep rally in the 2022 midterm races. They’re heading into the election cycle homestretch with a massive $124 million already spent on pro-abortion television ads — nearly 20 times what they spent pushing pregnancy termination in the 2018 midterms…”

In the end, we watched our promised red wave dry up into a pink trickle and instead had our a**es handed to us. And with its recently corrected status as a legislative matter, abortion promised to be a perennial issue. Right-wing strategists fretted that, with abortion on the table in every upcoming election from now on, there would always be enough single-issue pro-abortion voters to make it impossible for Republicans ever to win another election in almost every state as well as nationally.

I worried about this as well, but I was also hopeful that people would now be free to decide the abortion issue in a more regional and democratic manner. I figured it would settle into an uneasy peace sooner or later. Now, it looks as though the issue may already be easing down the importance scale, in time for the 2024 election.

Exhibit A is Florida. In April 2023, Florida Gov. Ron DeSantis signed the state’s “Heartbeat Protection Act,” banning most abortions after six weeks of gestation. The political strategist in me cringed. Florida’s deep red hue of recent years has been such a morale booster, that I was loathe to see it lost in the abortion wars. After legal challenges failed, the law went into effect last May, and I winced again. This election is crucial to America’s preservation, and if we couldn’t even hold Florida, what chance did the rest of the country have?
